About these terms

These terms govern use of HAMS, the Healthcare Agency Management System operated by Wilok Solutions Limited. By creating an organisation, signing in, or submitting an application you agree to them. They sit alongside the privacy notice.

If you use HAMS for a care agency, you also need whatever written agreement that agency has with Wilok Solutions Limited. Where those documents conflict, the written agreement prevails.

Accounts

  • Keep your login details confidential and complete two-factor authentication when asked.
  • Organisation owners are responsible for who they invite and which role each person has.
  • Tell the organisation owner promptly if you think an account has been misused.

Your organisation’s responsibilities

HAMS is software for running a care agency. It does not replace professional judgement, CQC registration, or legal advice. The agency remains responsible for:

  • Accuracy and timeliness of staff, applicant, and care records
  • Lawful processing of personal data, including DBS and health data
  • Signing processor agreements with vendors listed in the privacy notice
  • Staff training and a plan if the service is unavailable

Acceptable use

You must not:

  • Use HAMS for anything unlawful or to access another organisation’s data
  • Upload malware, or attempt to probe or disrupt the service
  • Share files or personal data with people who are not entitled to see them

Applications

Public application forms are submitted to the agency named on the form. Saving progress stores a draft for that agency. Submitting a form is an application to that agency, not to Wilok Solutions Limited.

Availability and changes

We aim to keep HAMS available but do not guarantee uninterrupted access. We may change features, require two-factor authentication, or update these terms. Continued use after an update means you accept the revised terms.

Liability

HAMS is provided for business use by care agencies. We do not exclude or limit liability where the law does not allow it, including for death or personal injury caused by negligence, or for fraud. Beyond that, we are not liable for decisions the agency makes using records in HAMS, or for losses that were not reasonably foreseeable.

Law

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that we may still take action in another country to protect the service.
